‘eyebright’ is defined as eyebright Ltd (SC367108) or any of its subsidiaries or trading names and any other entity we may legally transfer our rights under these Terms and Conditions.
‘The User’ is defined as anyone engaging with eyebright Ltd in any capacity and covers incorporated and unincorporated entities. This extends to anyone such as an employee, agent or affiliate regardless whether they have an independent legal status.
‘The Service’ is defined as someone who signs a Letter of Authority or otherwise provides consent for eyebright to provide comparisons, tenders or quotes.
‘The Supplier’ is defined as any entity eyebright may introduce The User to, or may be present on any quotes or illustrations.
‘The Contract’ is the agreement between The User and The Supplier, which has its own Terms and Conditions between the third party and The User, which eyebright has no control of.
The User accepts that in the event of any dispute which could not be defined that the legal jurisdiction of Scotland will apply and that the matter would be submitted to a Scottish court.
The User accepts that the Terms and Conditions represent the Entire Agreement and supersedes any previous understanding.
The User accepts that eyebright will store data associated with providing The Service.
The User consents for eyebright to credit check any entity or individual deemed relevant in delivering The Service. Under the Data Protection Act 1998, the data controller is eyebright Ltd, 44 Speirs Wharf, Glasgow, G4 9TH.
The User understands that eyebright may collect information from face to face meetings, emails, phone calls, written correspondence and web forms.
eyebright is entitled to be able to add you to email and written correspondence including marketing communication. You can opt out of this at any stage by emailing eyebright enquiries.
eyebright can with discretion use third parties outwith the UK to assist in administrative functions and processing personal information.
We can use your data in providing The Service, marketing to you and for statistical purposes.
eyebright can disclose data where it is forced or deems it is necessary for crime and fraud prevention.
The User accepts the legal jurisdiction of Scotland and accepts in the event of a dispute any matters may be settled in a Scottish court.
